High Court orders stay of appointment of administrator in Kalmakanda: Saidur Chairman in charge
The High Court has suspended the effectiveness of the government announcement and office order appointing the administrator of Lengura Union Parishad in Kalmakanda Upazila of Netrokona for three months.
At the same time, the court has issued a rule in this regard and ordered the concerned authorities to respond within four weeks.
As a result of this court order, the path for Md. Saidur Rahman Bhuiyan to continue as chairman has become clear, but administrative complications and confusion have arisen in the area.
The High Court issued this order in the wake of a writ petition filed by Union Parishad Chairman Md. Saidur Rahman Bhuiyan.
The rule sought to know why the announcement issued under sections 101 and 102 of the Local Government (Union Parishad) Act, 2009 should not be declared illegal.
According to court sources, the declaration issued on January 18, 2026 and the office order issued on January 19, 2026 signed by respondent No. 3 will remain in effect for three months until the final hearing.
According to lawyers, there is no legal impediment to Saidur Rahman Bhuiyan from performing his duties as chairman until the final verdict is delivered.
Despite the court’s stay order on January 29, there have been local allegations that the appointed administrator, Upazila Social Service Officer Md. Rezaul Karim, is continuing the activities of the Parishad.
The issue has created curiosity and confusion in the area. In this regard, Chairman Saidur Rahman Bhuiyan said, “I respect the rule of law and the court. Since the court has given a stay order, there is a legal basis for me to continue in my post.”
Appointed UP Administrator Md. Rezaul Karim “I am performing my duties on the orders of the UNO sir. I do not know anything about the court’s stay order.”
Netrokona Deputy Commissioner Md. Saifur Rahman: “I have not received a copy of the stay order yet. It is difficult to comment on this issue without receiving instructions from the headquarters.”
According to legal experts, conducting administrative activities while the High Court’s stay order is in force can create legal complications.
According to informed sources, this situation has arisen due to lack of coordination between the administration and the court order. The final legal position on this issue is expected to be clear in the rule hearing after the next four weeks.
