No transfer-vacation in five city corporation elections without permission of EC

The Election Commission (EC) has directed the government not to transfer or leave anyone from the constituencies without permission on the occasion of the upcoming five city corporation elections. It is said that this instruction will be effective till 15 days after the election.

On Saturday (April 29), the deputy secretary of the EC’s election management branch said. Atiyar Rahman said, the directive has already been sent to the Cabinet Secretary.

It has been mentioned in the instructions that Gazipur City Corporation elections will be held on May 25, Khulna and Barisal City Corporation elections on June 12 and Rajshahi and Sylhet City Corporation elections will be held on June 21.

Returning Officers and Assistant Returning Officers have been appointed to conduct the elections. For smooth execution of election related functions, it will be necessary to appoint required number of Polling Officers from among the officers and employees of all Ministries/Departments as well as Government, Semi-Government, Autonomous, Semi-Autonomous Offices/Institutions and in some cases from Private Offices/Institutions. Election of some of the officers/employees may require them to perform other duties.

Apart from appointing a significant number of polling officers from among the teachers of government, government-aided and private educational institutions, various duties will be given in the elections. Necessary number of magistrates and law enforcement personnel will be deployed to maintain law and order in the elections. Moreover, the premises/premises of various institutions/organizations will be used as polling stations.

The directive also states that according to Article 126 of the Constitution of the People’s Republic of Bangladesh, it is the duty of all executive authorities to assist the Election Commission in discharging its duties and any person or executive of the state to assist the Election Commission in discharging its duties in accordance with Rule 3 of the Local Government (City Corporation) Election Rules, 2010. may give necessary directions to the authority and if so directed, the said person or executive authority shall be obliged to perform the said duties or to render such assistance.

According to rule 89 of the said rules, the officials mentioned in the rules cannot be transferred to another place without consultation with the Election Commission until 15 days after the publication of the results in the official gazette after the notification is issued.

According to the Election Officers (Special Provisions) Act, 1991, a person appointed to perform election related duties shall be deemed to be serving on deputation under the Election Commission as an additional duty of his service until he is relieved from election duty after such appointment.

In this situation, the persons engaged in the election work will assist the Election Commission as in the past by impartially fulfilling the duties assigned to them in accordance with the laws and regulations in order to carry out the mentioned election activities properly.

All Ministries/Departments i.e. Govt, Semi-Government, Autonomous to ensure that the persons engaged in election work are not transferred or given leave or engaged in any work which may interfere with the election duties until the Election Commission releases them. And requested to direct the private offices/institutions/organizations.
