What the Law Minister said about whether 2 judges of Brahmanbaria will be transferred or not

Law Minister Anisul Haque said that it is the jurisdiction of the General Administration Committee (GA) of the Supreme Court to see whether the two judges of the Brahmanbaria court will be transferred. I will not say anything there. Judiciary is completely independent. The GA Committee considers transfer proposals of judges.

He said the caretaker government system has been declared illegal by the court. Amendments have been brought to the constitution based on the verdict. I see no possibility of a return to caretaker government.

The minister said these things in response to questions from journalists after a program at the Judicial Administration Training Institute in Dhaka on Saturday. Earlier, he addressed the chief guest at the inauguration of the 10th Orientation Course organized for the newly promoted Additional District and Sessions Judges/Equivalent Judges.

Mentioning the incident of indecent behavior of lawyers in Brahmanbaria court as very unfortunate, he said, we are trying to solve this problem. The bar and bench are like a family. Such incidents are not unusual. But we want such incidents not to happen again.

Regarding the name appearing in the list of potential presidents, the minister said, it is a rumour, don’t listen to it.

Earlier in the event, the Law Minister said that Bangabandhu Sheikh Mujibur Rahman had dreamed of such an independent, impartial and dynamic judiciary, where exploited-deprived-oppressed and helpless people would get speedy justice at low cost. In fact, justice is as essential to life as food and clothing. Because life cannot survive without food, just as people cannot go out in public without clothes, similarly people cannot live peacefully in society without justice.

He said, in the absence of justice, chaos occurs in society, social instability or instability occurs. And since society is the state, unstable society means unstable state. Foreign countries are reluctant to establish friendship or relations with such a state, they are afraid to invest. As a result, the country is isolated from the international community, development is disrupted. Therefore, the father of the nation has always been active in establishing the rule of law and justice. Even during the Pakistani regime, he spoke with a strong voice for ensuring rule of law, justice and equality of opportunity wherever he got a chance.

He believes that the Judiciary can get rid of the burden of cases through the various initiatives of the Government and the Supreme Court as well as the innovative steps of the learned Judges, proper implementation of judicial working hours, effective case management system, efficient court management and above all effective coordination of their skilled leadership. Through effective coordination with the parties involved in the trial process, the case can be disposed of quickly. He expressed hope that all judges will play a significant role in these cases.

The law minister also reminded that one of the characteristics of Bangladesh’s judicial system is that there are many parties to a case. One side wants the case to be settled quickly, the other side wants the time to settle the case to be prolonged. Some delay the court by filing false cases of harassment. We have to move forward with these things in mind. Justice must be served speedily. Again in this case we should not forget ‘Justice Hurried is Justice Buried’. Justice is different from generosity, magnanimity, gratitude, friendship and mercy. At the core of the criminal justice system is the concept of impartiality.

Director General of Judicial Administration Training Institute Justice Nazmun Ara Sultana presided over the ceremony, Secretary of Law and Justice Department. Golam Sarwar and Institute Director (Training) Sheikh Ashfakur Rahman spoke.
