Writ seeking postponement of by-election of Gaibandha-5 constituencies

A writ petition has been filed seeking postponement of the by-election proceedings of Gaibandha-5 constituency as the election date was fixed without rescheduling. In the writ, the validity of the letter sent by the Election Commission on December 26 has been challenged and its effectiveness has been suspended. At the same time, a request has been made to issue a rule.
Chief Election Commissioner, Returning Officer, Gaibandhar DC, District Election Officer have been made respondents in the writ.
On Wednesday (December 28) in the relevant branch of the High Court, Advocate Md. Yunus Ali Akand filed a writ.
Lawyer Yunus Ali Akand said that Article 123 (4) of the Constitution states that the election schedule must be announced within 90 days of the declaration of vacancy. If this is not the case, the schedule must be announced again within the next 90 days. However, without announcing the schedule again, the Election Commission has announced the election date on January 4 with a letter on December 26. Which is a violation of Article 123 (4) of the Constitution. He also said that this is a violation of RPO 1972.
On Thursday (December 29) regarding the writ, High Court Judge Md. A bench consisting of Nazrul Islam Talukder and Justice Biswajit Debnath may be heard.
Various irregularities occurred on the election day of Gaibandha-5 seat last October 12. Later, the Election Commission declared the election closed.
